US Court Mandates Freedom of Abrego Garcia from Immigration Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks lawful basis.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation originates in a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his repatriation to the United States to answer human smuggling allegations, he was held in federal detention.
In her order, the court noted that the authorities lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
